2. Eligibility

To use the Service, you must be at least 16 years of age and have the legal capacity to enter into a binding contract under applicable law. Users under the age of 18 require the consent of a parent or legal guardian to subscribe to a paid plan. By using the Service, you represent and warrant that you meet these requirements. If you are accessing the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Account Registration and Security

Access to certain features of the Service requires registration of a user account. You agree to provide accurate, complete, and current information during registration and to keep it up to date. You are solely responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials. You must notify us immediately at dmitrii@mappy-ai.com if you suspect unauthorised use of your account. Mappy AI is not liable for any loss or damage arising from your failure to safeguard your credentials.

4. Acceptable Use

You agree not to use the Service to:

• Upload, submit, or distribute content that is unlawful, defamatory, harmful, obscene, or that infringes on any third-party intellectual property rights or data protection rights.
• Attempt to gain unauthorised access to any part of the Service or any other user's account or data.
• Interfere with, disrupt, or overload the Service or its underlying infrastructure.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
• Use the Service to transmit unsolicited commercial communications (spam).
• Engage in any conduct that violates applicable Swiss law or international law.

We reserve the right to suspend or terminate access to the Service for any User who violates these acceptable use obligations, without prior notice and without entitlement to a refund.

5. User Content

You retain full ownership of all files, links, text, and mind maps you upload or create using the Service (“User Content”). By submitting User Content, you grant Mappy AI a limited, non-exclusive, royalty-free, worldwide licence to host, store, process, reproduce, and display your User Content solely to the extent necessary to provide and improve the Service for you. This licence terminates when you delete your content or close your account, subject to any retention obligations under applicable law.

You are solely responsible for ensuring that your User Content does not violate any applicable laws, third-party rights, or these Terms. Mappy AI does not pre-screen User Content and is not liable for any User Content.

6. AI-Generated Outputs

The Service uses artificial intelligence to generate mind maps and related content. AI-generated outputs are produced automatically and may be inaccurate, incomplete, biased, or otherwise unsuitable for your specific purposes. You are solely responsible for reviewing and verifying AI-generated outputs before relying on them, particularly for academic, legal, medical, financial, or safety-critical decisions. Mappy AI makes no warranty as to the accuracy, reliability, or fitness for purpose of any AI-generated content.

7. Subscription Plans, Billing, and Cancellation

Mappy AI offers both free and paid subscription plans. Paid plans are billed in advance on a recurring basis (monthly or annually, as selected) and renew automatically at the end of each billing period unless cancelled before the renewal date.

You may cancel your subscription at any time via your account settings or by contacting dmitrii@mappy-ai.com. Upon cancellation, your access to paid features continues until the end of the current billing period. Subscription fees are non-refundable, except where required by applicable Swiss consumer protection law or as otherwise stated at the time of purchase.

We reserve the right to change our pricing. Any price changes will be communicated at least 30 days in advance and will take effect at your next renewal date.

8. Intellectual Property

The Service, including its software, design, trademarks, and content developed by Mappy AI, is protected by Swiss and international intellectual property law. Nothing in these Terms transfers any intellectual property rights in the Service to you. You may not copy, reproduce, modify, or distribute any part of the Service without our prior written consent, except as expressly permitted by these Terms or applicable law.

9. Service Availability and Changes

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature or aspect of the Service at any time for operational, legal, or technical reasons. For material changes that adversely affect paid subscribers, we will provide reasonable prior notice. Mappy AI is not liable for any interruption, modification, or discontinuation of the Service.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted under Swiss law, we do not warrant that the Service will be error-free, secure, or meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by Swiss law, Mappy AI's total liability for any claims arising out of or in connection with these Terms or the Service shall be limited to the fees paid by you to Mappy AI in the 12 months preceding the claim. Mappy AI shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of profit, or loss of opportunity, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for damages caused by gross negligence or wilful misconduct (Art. 100 OR), personal injury, or any liability that cannot be excluded under mandatory Swiss law.

12. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them shall be governed exclusively by Swiss law, to the exclusion of conflict-of-law rules and the Vienna Convention on the International Sale of Goods (CISG). The exclusive place of jurisdiction for any disputes is Zurich, Switzerland, subject to any mandatory statutory provisions granting another place of jurisdiction to consumer users.

13. Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, pricing, or legal obligations. Material changes will be communicated via email or a prominent notice on our website at least 14 days before they take effect. If you do not agree with the updated Terms, you may terminate your account before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
